Parental Rights – File a Due Process Complaint

This right is covered in section 300.508 of IDEA.

You have the right to file a due process complaint. Your public agency should have a way for you (or your attorney) to serve this in a confidential manner. IDEA lays out specific minimum criteria for submitting a due process complaint (including student name, address, school, problem and proposed resolution).

Once a due process complaint has been filed, the hearing officer has 5 days to ensure that these minimum criteria are met. Then the LEA (local educational agency) has 10 days to reply to you as the parent. This response must explain why they did or didn’t take the actions in question, what other options were considered/why they were rejected, evaluations used and any other relevant information.
