Parental Rights – Confidentiality

Parents have the right to examine their child’s records, per Sec. 300.613 of IDEA.

Therefore, you can review any of your child’s records “collected, maintained or used by the agency”. The time frame to obtain these records is unclear, but must be without unnecessary delay (this may look different in different situations).

Besides just getting to view the records, you also have the right to have these records explained to you either by the school/agency itself or by your own advocate or representative.

You can also request something changed or added to the record if you see fit. Remember that you are an important member of the IEP team!
