Parental Rights – Consent: Consent for Reevaluation

You have the right to ask for a reevaluation as part of IDEA Sec. 300.300 (c)

This is similar to the initial consent. Children identified with special needs will require reevaluation at various points. The school/agency must reach out to you and make a reasonable effort to get your consent to reevaluate your child.

However, if you do not respond to these attempts, the school may still choose to move forward with the reevaluation. There are also ways in which the school can override your refusal if they deem it necessary using either due process or mediation rights afforded to the school.
